Terms of Use

1. Apps Covered

These terms apply to all iOS, iPadOS, watchOS, and macOS apps published by Andy Arevalo, including: OnTime Speaker Pro, OnStage Timer Pro, Not Another Twin Calculator, Not Another Stage Timer, Not Another Countdown, Not Another Fasting Timer, Not Another Coloring Book, Duse – Habit Tracker, ThermoTimer, RoadWatch CA, Student Guardian (SchoolSync), CareLedger, PawLedger, PetSitterPro, Healko, Kickoff (Weight Loss & Fitness), NetForge: Engineer's Toolkit, and future releases.

1.1 Health, Fitness, and Wellness Disclaimer

IMPORTANT. Several apps in this portfolio handle health-, fitness-, or wellness-related information. This includes CareLedger (medication tracking), PawLedger (pet medication and vaccination records), Healko (Apple Health ↔ Home Assistant bridge), Kickoff (weight and body-fat tracking), and Not Another Fasting Timer (intermittent fasting timer).

These apps are not medical devices. They do not diagnose, treat, cure, or prevent any disease, and they must not be used to make medical decisions. The values shown reflect data you have already collected through devices and services you own.

Specifically:

• CareLedger / PawLedger are personal medication-tracking utilities. They are NOT HIPAA-compliant and should NOT be used by healthcare providers, covered entities, or for any purpose requiring HIPAA compliance.
• Healko is a home-automation utility that bridges existing Apple Health data to a Home Assistant instance you control. It does not connect to medical hardware.
• Kickoff tracks weight and body-fat values you log; it does not provide weight-loss medical advice.
• Not Another Fasting Timer is an informational timer for intermittent-fasting protocols. Multi-day fasts (36 h, 48 h, 72 h) can carry serious health risks and require medical supervision; the app shows an explicit confirmation gate before allowing extended fasts, but this is not a substitute for consulting a qualified healthcare provider.

Always consult a qualified healthcare provider before making medical decisions, beginning a new diet or fasting protocol, or changing medication. Information displayed by these apps (including any AI-generated text) is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

2. Use of the Apps

You may use our apps for personal or professional purposes. Prohibited activities include:

• Reverse engineering or decompiling
• Modifying apps or accessing source code
• Bypassing security measures
• Unauthorized copying or distribution
• Unlawful use

3. User-Generated Data

You are responsible for data accuracy and maintaining backups. We do not access, store, or transmit your content unless you choose to export it.

4. Purchases, Subscriptions, and Billing

Payments are handled solely by Apple using your Apple ID. We do not collect billing information. The following terms apply to in-app purchases and subscriptions:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewable subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• Free trials, where offered, automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.
• You can manage or cancel subscriptions in your iOS Settings → Apple ID → Subscriptions, or at support.apple.com/HT202039.
• One-time (non-consumable) purchases unlock the relevant feature permanently for the purchasing Apple ID, subject to Apple's "Restore Purchases" mechanism.
• Refunds are handled exclusively by Apple per their policy at support.apple.com/HT204084. We do not have the ability to issue refunds directly.

5. Disclaimer of Warranties

Apps are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees regarding error-free performance, timing suitability for safety-critical applications, or device compatibility.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANDY AREVALO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPS. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED FIFTY US DOLLARS ($50 USD) OR THE TOTAL AMOUNT YOU PAID FOR THE RELEVANT APP IN THE TWELVE MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER. Your sole remedy in the event of dissatisfaction is to discontinue use of the apps.

7. Intellectual Property

All branding, icons, features, and design elements belong to Andy Arevalo and cannot be redistributed without permission.

8. Termination

We may suspend access for violations. You may discontinue use by deleting the apps.

9. Apple as Third-Party Beneficiary

You acknowledge that these terms are between you and Andy Arevalo, not Apple. Apple is not responsible for any of the apps or their content. Apple and its subsidiaries are third-party beneficiaries of these terms and have the right (and are deemed to have accepted the right) to enforce these terms against you as third-party beneficiaries.

10. Governing Law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising under or in connection with these terms shall be resolved in the state or federal courts located in Orange County, Florida.

11. Changes to These Terms

Updates may occur and will be posted at andyarevalo.com/terms.html with an updated "Last Updated" date. Continued use of the apps after changes constitutes acceptance of the revisions.
